Terms of Sales

1) Introduction

Accepting delivery of products purchased through Toycatacomb.com, you agree to be bound by and accept these Terms of Sale. Toycatacomb.com reserves the right to alter these Terms of Sale at any time, without notice.

2) Payment

Customers purchasing products online from Toycatacomb.com will be billed at the completion of checkout. Customer will pay full amount of invoice for products provided by Toycatacomb.com which will be submitted to them at the end of an assignment. All goods remain the property of Toycatacomb.com until paid for in full.

Prices for products and services are exclusive of all sales and other taxes based upon the value of the products or services. Customer is responsible for payment of all such taxes.

3) Satisfaction Guarantees

Satisfaction guarantees vary depending on the specific Product Customer purchases. The duration of the guarantee provided herein and any applicable response times will vary according to the particular product purchased under this agreement. Customer may obtain details of the specific product guarantee from Toycatacomb.com. The applicable guarantees that apply to customer's purchases begin on the effective date of that purchase.

No guarantee will apply to any product that has been modified, altered, or adapted, maltreated or used in a manner other than in accordance with the product manual or, repaired.

4) Taxes

Only those customers residing in Canada will have sales tax added to their orders. Unless Customer provides Toycatacomb.com with a valid government or non-profit tax exemption certificate, Toycatacomb.com will withhold sales tax where applicable. Even if Toycatacomb.com does not withhold sales tax, Customer may be responsible to pay sales tax in its state, county, or municipality.

5) Availability

Services may not be available in certain locations, and Deliverables may vary between locations. Services are subject to availability of qualified Toycatacomb.com personnel and facilities and/or may be subject to additional costs or terms and conditions or to payment of minimum applicable fees.

6) Subcontractors

Toycatacomb.com may use subcontractors in the performance of its obligations under this Agreement, in which case Toycatacomb.com will remain responsible for the delivery of Services.

7) Shipment and Damage

Toycatacomb.com will ship to Customer addresses worldwide. Product price does not include shipping and material costs. Customer agrees to pay full shipping charges as indicated on Toycatacomb.com website.

Toycatacomb.com may deliver products in installments. Any delivery or shipment date provided to Customer is Toycatacomb.com's good-faith estimate. Toycatacomb.com will not be liable for any loss, damage, cost, or expense related to any delay in shipment or delivery.

If loss or damage of Product occurs during shipment, Customer must contact Toycatacomb.com within 30 days of purchase. Insurance is available for Customers located in Canada and USA only. Personal information such as name, address and telephone will be submitted to CanadaPost for insurance claim.

If any items are missing from the contents of the original package, please contact Toycatacomb.com support@toycatacomb.com, within the first 30-days of purchase.

8) Product Warranty and Technical Support

There is no warranty on any product purchased from Toycatacomb.com. However, Product NOT marked "No Return Available" qualify for Product Satisfaction Guarantee detailed in Section 2. Technical support is only available for Services and may be requested by e-mail.

9) Cancellation

Once an order is submitted online through Toycatacomb.com and the order is paid for through third party payment services, the order cannot be cancelled online.

10) Return for Refund/Credit

Unless the product purchased is marked "No Return Available" Toycatacomb.com will accept product returns within 14-30 days as indicated on Product on Toycatacomb.com beginning from the date the product is purchased.

11) Return Submission

All returned goods must be shipped freight prepaid at customer's expense in their original boxes and packing material. A copy of your invoice must accompany all returned Products, along with a detail description of problem encountered. Returned goods should be freight insured by you.

12) Limitation of Liability

Under no circumstances are we liable for the following:

  1. third-party claims against you for damages;
  2. loss of, or damage to, your records or data; or
  3. economic consequential damages (including lost profits or savings) or incidental damages even if we are informed of their possibility. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you.
