Copyright Policy
Toycatacomb.com respects work done by others, and we ask users to do the same. This copyright policy protects Toycatacomb.com' work as well as work done by others. If copyright infringement is suspected then the following steps/actions must be taken.
1) Initial Notification
If you suspect that your copyrighted work has been reproduced, imitated, or replicated and is accessible on Toycatacomb.com' website in any way that constitutes copyright infringement, please send a notification to our copyright staff providing the following information:
- A physical or electronic signature of the complaining parties "Owner's" copyrighted work or the person authorized to act on the complaining parties "Owner's" behalf.
- A description of the copyrighted work that you claim has been infringed as well as a description of the infringing activity. If you claim multiple copyrighted works have been infringed then provide such in a representative list.
- A description of where the material that you claim is infringing is located, such as the URL of where it is posted.
- Information of the complaining party, such as name, address, telephone number, and if available, an electronic mail address at which the complaining party may be contacted.
- A statement that the complaining party has a good faith belief that the disputed use of the material is not authorized by the copyright complaining party "Owner", its agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on the copyright complaining party "Owner's" behalf.
2) Receipt Notification
Upon receipt of the written notification containing the information as outlined above in Initial Notification, the following action will be taken:
- Alleged infringer will remove or disable access to the material that is alleged to be infringing.
- Written notification will be forwarded to complaining party.
- Reasonable steps will be taken to promptly notify the complaining party that the infringed content has been removed or disabled access to the material.
3) Counter Notification
To be effective, a written counter notification must be provided to alleged infringer’s designated agent that includes the following:
- A physical or electronic signature of the alleged infringer.
- Identification that the material has been removed or access to the material has been disabled. Also, the location at which the material appeared before was removed or access to it is disabled.
- A statement under penalty of perjury stating the alleged infringer has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
- The alleged infringer’s name, address, telephone number, and a statement that consents to the jurisdiction of federal district court for the judicial district in which the address is located, or if the alleged infringer address is outside of Canada, for any judicial district in which the alleged infringer may be found, and that the alleged infringer will accept service of process from the person who provided notification or an agent of such person.
4) Receipt Counter Notification
Upon receipt of the written counter notification containing the information as outlined above in Counter Notification, the following action will be taken:
- Alleged infringer will promptly provide the complaining party with a copy of the Counter Notification.
- Alleged infringer will inform the complaining party that it will replace the removed material or cease disabling access to it within ten business days.
- Alleged infringer will replace the removed material or cease disabling access to the material within ten to fourteen business days following receipt of the Counter Notification, provided that the alleged infringer's designated agent has not received notice from the complaining party that an action has been filed seeking a court order to restrain the alleged infringer from engaging in infringing activity relating to the material on alleged infringer's network or system.
5) Copyright Infringement Contact
